DIRECTOR OF CORPORATE COMPLIANCE

GENERAL PURPOSE

Accountable for Salient’s compliance program including healthcare sales, marketing compliance, audits and education/training activities. Responsibilities include the development and implementation of policies and procedures, annual plan development review of compliance related complaints, ensuring appropriate reporting of potential violations, identification of areas of vulnerability, development of corrective action plans and oversight of monitoring activities. Will serve as a role model for compliant behavior consistent with Salient’s vision, mission and values


ESSENTIAL DUTIES AND RESPONSIBILITIES

  • Develop, implement and monitor a comprehensive organization-wide audit and compliance program that ensures full compliance with federal and state regulatory requirements
  • Update and implement best practices in existing compliance program
  • Initiate, maintain, and publicize a confidential and easily accessible system for employees to report alleged violations of standards without fear of retribution.
  • Implement and maintain a system of management reporting that provides timely and relevant information on all aspects of audit and compliance issues.
  • Exercise due diligence in working with management to prevent and detect misconduct and wrongdoing. Undertake all reasonable steps to respond appropriately when an offense is suspected and/or detected and prevent future similar offenses.
  • Train sales force and select Salient employees on compliance program and applicable local, state and federal laws
  • Ensure corporate training programs are up to date with appropriate regulations and guidelines
  • Serve as an internal authority on relevant laws and regulations, keeping abreast of current changes that may affect Salient’s business through personal initiative, seminars, training programs, and peer contact.
  • Review proposed transactions with healthcare providers, institutions and associations to ensure compliance with local, state, and federal law. 
  • Audit payment transactions to healthcare professionals, expense reports, and training effectiveness
  • Review personal service agreements and other contracts with healthcare professionals to ensure compliance with applicable laws, regulations and Salient policies
  • Lead and coordinate internal investigations
  • Review prior to publishing and dissemination of Salient’s website, collateral and marketing materials, sales tools, surveys, communications to customers and referral sources, applicable contracts and forms, scripting, voice recorded company messages, external presentations, if appropriate, and advertising to ensure compliance.
  • Serve as Salient’s point of contact with all outside legal counsel; track and report legal utilization; and coordinate any investigations
  • Monitor changes in law and enforcement relevant to transactions with healthcare providers
  • Develop a compliance group as necessary to support Salient’s need to remain compliant with local, state and federal law
  • Work with operational leadership to provide adequate information to ensure that they and their employees have needed information and knowledge of regulatory issues and requirements to carry out their respective responsibilities in a lawful and ethical manner
  • Collaborate with Training, Development & VP of QA & Regulatory to develop, implement and/or facilitate education programs addressing compliance proactively and responsibly as circumstances may indicate

 

DESIRED MINIMUM QUALIFICATIONS

Education and Experience:

  • J.D. from an accredited law school and admitted into the state bar
  • 8-10 years of experience as an attorney
  • Experience with healthcare compliance issues with focus in medical device industry
  • Experience with drafting contracts and negotiation

Necessary knowledge, skills and abilities:
Ability to communicate effectively, both orally and in writing, with employees, physicians, consultants, counsel, and governmental agency representatives
